Settlement vs. Litigation

Legal disputes within a family can be highly emotional and very adversarial, but no matter how large or small the dispute may be, it is the children who suffer most when there are displays of anger and animosity between parents.  A legal battle between parents may affect their children’s emotional outlook for many years.  It is far better to pursue a low conflict settlement, so that the parties are able to focus on their children and what is in their best interests, both short and long term.  There is no reason why a child cannot thrive after a divorce if regard is given to their best interests.  This is just one of many reasons to strongly attempt settlement of all custody, parenting time, and support conflicts.  Other reasons, of course, are time, money, and your own mental and emotional well-being; but whether children are involved in a family dispute or not, it is important to remember that a lengthy and aggressive legal battle typically benefits no one except the lawyers.
